Fleming moves forward with reorganization

During a May 4 hearing in the United States Bankruptcy Court in Delaware, Fleming Companies Inc announced that it reached an agreement in principle with the Official Committee of Reclamation Creditors and the Official Committee of Unsecured Creditors regarding reclamation claims. This resolves the objections of the Reclamation Committee to Fleming’s proposed plan of reorganization.

The Lewisville TX-based company expects to file with the court soon its third amended plan of reorganization and disclosure statement that will reflect terms of this agreement. A hearing on the pending plan of reorganization is scheduled for May 25 at 1 pm in the Delaware Bankruptcy Court.

Fleming and its operating subsidiaries filed voluntary petitions for reorganization April 1, 2003, under Chapter 11 of the US Bankruptcy Code.
